Section 17 pace

Recommended Posts

I understand you can use section 17 to enter a premises to arrest someone for an indictable offence, but does this include either way offences?

for example a police officer is in pursuit of a shoplifter, the shoplifter lives across the road and runs in to his house. Can the police officer enter to make the arrest?

S17 provides a power of entry to arrest for indictable offences and some specified non-indictable offences. The legislation doesn't stress indictable ONLY.

As theft is an either way offence, my interpretation of S17 would mean the answer has to be yes, as the offence can be tried either way.
