Deliberately scratched car and racial abuse

Scenario.  A man scratches a car for parking in his spot. The owner of the car returns and is of Asian descent. The Man verbally abuses the woman bringing her race and colour into the abuse. Because the car was damaged before the man knew of her race or religion is this still criminal damage racially religiously aggravated section 30 crime and disorder act or is it 2 separate offences

Two separate offences. Criminal Damage and probably Racially Aggravated Sec 4a, Public Order Act. But with the exact detail of what he said and did to her it could be anything from not a crime at all to threats to kill.

It is what the complainant, yourself or third party believes, if any say it is racist then that is what the crime will be……………that is how we work.

Not quite. "A racist incident is any incident which is perceived to be racist by the victim or any other person."
Whereas to be a racist crime, or rather racially aggravated crime, the circumstances must fit the definition as per the Crime and Disorder Act 1998 (as amended).
